Guardant Health to Appeal Delaware Court Ruling in Patent Dispute; Shares Fall

By

Guardant Health (GH) said Monday it will appeal the final judgment of a Delaware district court related to a patent infringement dispute with TwinStrand Biosciences and University of Washington.

The company said execution of the court's final decision and collection of potential royalties are on hold, pending the appeal.

The potential royalties do not apply to the company's current versions of Guardant Reveal and Shield, which feature updated technology. Additionally, the company has made design improvements to Guardant360 that would exclude the impact of potential ongoing royalties.

The patents have also been preliminarily invalidated in separate challenges before the US Patent and Trademark Office, the company added.

Shares fell around 3.5% in late afternoon trading.
