Otter Tail (OTTR) said Friday it has reached two settlement agreements in a federal PVC pipe antitrust class action.
The company agreed to pay about $39.5 million to resolve claims from the Direct Purchaser Class and $34 million to resolve claims from the Non-Converter Seller Purchaser Class, subject to court approval. A third class action, brought by End-User plaintiffs, remains pending
If the settlements receive preliminary approval, the payments will be made roughly 21 days afterward, the company said. Otter Tail said the agreements do not constitute an admission of wrongdoing, fault, or liability.
The company expects to use available cash to fund the payments, and the settlements are not expected to have a material adverse effect on its financial position or liquidity.
