Lotus Pharmaceutical (TPE:1795) subsidiary Norwich Pharmaceuticals won a ruling from the U.S. Court of Appeals for the D.C. Circuit over its application to sell Rifaximin tablets, a generic version of Xifaxan, according to a Wednesday Taiwan Stock Exchange filing.
The drug is used to treat irritable bowel syndrome (IBS) with diarrhea in adults.
The U.S. appeals court said the Food and Drug Administration had used the wrong standard when deciding that another drugmaker still had exclusive marketing rights.
The case will now return to the FDA for further review, it said.
