Amazon (AMZN) was rebuffed by the Ninth Circuit Court of Appeals on Tuesday, overturning a preliminary injunction that had barred Perplexity's Comet browsing agent from operating on Amazon.com
The court found that Perplexity's AI agent does not "access" Amazon's computer systems within the meaning of the Computer Fraud and Abuse Act.
The panel reasoned that Perplexity's practice of relaying screenshots of Amazon pages to its own servers to carry out tasks does not amount to accessing Amazon's servers, undercutting the core of Amazon's legal theory.
The three-judge panel limited its holding to the specific facts of the case and sent the matter back to the district court for further proceedings.
